Certificate of Building Code Compliance Law

 

 

Excerpt from the Village Of Dansville Local Law Number Three (3) of the year nineteen hundred ninety two, 1992:

 

 

§ SECTION 7 – CERTIFICATE OF BUILDING CODE COMPLIANCE

 

         (A)  No owner of property, including but not limited to landlords and rooming house owners, shall permit his property to be occupied by another, unless and until the dwelling unit and all areas and utilities associated therewith are in good repair, clean, sanitary, in habitable condition and in full compliance with the New York State Uniform Fire Prevention and Building Code, and all other local laws, codes and ordinances of the Village of Dansville as certified in advance of such occupancy through a Certificate of Building Code Compliance to be issued by the Enforcement Officer of the Village of Dansville, Livingston County, New York.

 

  (B)  Each owner of rental property, and each owner of a rooming house, in the Village Of Dansville, is hereby required to immediately notify the Code Enforcement Officer when any rental dwelling unit is or is to be vacated by a tenant or border. If the landlord requests and the old tenant permits, the Code Enforcement Officer may make his inspection and issue the certificate at that time. In no event can said dwelling unit be rented to a new or different tenant(s) until a Certificate of Building Code Compliance has been issued by Code Enforcement Officer within thirty (30) days prior to the new tenant’s moving in.

 

  (C)   Upon the sale of real property, or any other transfer of real property other than referred to in paragraph 7b above, the transferee shall not occupy any portion of the premises until there is first obtained a Certificate of Building Code Compliance, which certificate must be issued within thirty (30) days prior to said occupancy.

 

  (D)  The fees to be paid for the Certificate of Building Code Compliance are as follows: 

                          

    Initial inspection – Apartment/Room  - - $ 15.00 unit {fee schedule was revised as of May 2001}

-         Home Sale  - - $ 50.00 + $ 10.00 unit {fee schedule was revised as of May 2001}

                            For the second return visit - $100.00

                                             On the third and all subsequent visits until all violations are cured - $200.00 per visit.

 

                  (E)  When a Certificate of Building Code Compliance is required hereunder, no person, whether a purchaser, renter, boarder or other new occupant shall occupy the premises until such Certificate of Building Code Compliance has been obtained.

 

  (F)  CRIMINAL VIOLATION – In addition to all other remedies provided in this local law, each owner of property who allows any portion thereof the be rented or occupied without first obtaining a Certificate of Building Code Compliance as required in paragraphs 7a and/or 7b above, and each transferee of property who occupies any  portion thereof without first obtaining a Certificate of Building Code Compliance as required by paragraph 7c above, shall be guilty of a criminal violation, the sentence for which shall be a mandatory fine of $250.00 for each week or part thereof commencing from the date of occupancy until the time that the aforesaid certificate is obtained. It shall be no defense that the offender did not know and/or was not notified of his violation of this local law.”
